History. This publication is a major revision. The portions affected by this major revision are listed in the summary of change.
Authorities. The authority for this publication is DoDM 5200.02.
Applicability. This regulation applies to the Regular Army, the Army National Guard/Army National Guard of the United States, and the U.S. Army Reserve. It also applies to Department of the Army Civilians and other individuals who are in direct support of Army missions (such as tribal, state, and local employees, volunteers; Intergovernmental Personnel Act participants; and Science, Mathematics, and Research for Transformation Students) or are affiliated with the Army, and Department of the Army contractors, in national security or sensitive positions. This regulation also applies to—
a. Persons employed, hired on an individual basis, or serving in an advisory or consultant basis (including the Pathways Program, re-hired annuitants, and summer hire students) for which DA national security eligibility is required, whether or not such persons are paid from appropriated or non-appropriated funds.
b. Personnel assigned, attached, or employed by organizations in which the Secretary of the Army exercises Executive Agent authority over the organization or subject matter.
Proponent and exception authority. The proponent of this regulation is the Deputy Chief of Staff, G–2. The proponent has the authority to approve exceptions or waivers to this regulation that are consistent with controlling laws and regulations. The proponent may delegate this approval authority, in writing, to the Deputy Chief of Staff, G–2, Director, Counterintelligence, Human Intelligence, Disclosure and Security. Further delegation is prohibited. Activities may request a waiver to this regulation by providing justification that includes a full analysis of the expected benefits, a demonstration that the requested exception would not violate Department of Defense or Executive Branch policies and must include formal review by the activity's senior legal officer. All waiver requests will be endorsed by the commander or senior leader of the requesting activity and forwarded through their higher headquarters to the policy proponent. Refer to AR 25–30 for specific requirements.
Army internal control process. This regulation contains internal control provisions in accordance with AR 11–2 and identifies key internal controls that must be evaluated (see app E).

Glossary
Access The ability and opportunity to obtain knowledge of national security information. An individual may have access to national security information by being in a place where such information is kept, if the security measures that are in force do not prevent the individual from gaining knowledge of such information (see DoDM 5200.02).
Adjudication The evaluation of pertinent data in a background investigation, as well as any other available information that is relevant and reliable, to determine whether a covered individual is eligible for access to classified information or to hold a sensitive position (see EO 13467).
Administrative action Limited to personnel security actions and security clearance eligibility determinations. Does not include or limit the use of civilian personnel actions (for example, disciplinary or adverse actions under 5 USCUSCUnited States Code).
Affiliated Military, civilian, and contractor personnel performing sensitive duties (national security positions) for or on behalf of the DA. Also includes other individuals in national security positions: subcontractors, licen- sees, certificate holders, grantees, experts, consultants. and advisors (paid or unpaid), interns, volun- teers, other types of Army employment (for example, Intergovernmental Personnel Act participants and Science, Mathematics, and Research for Transformation Students), applicants for Army employment or military service who have signed SF 86 or its successor form, organizations in which the Secretary of the Army is the executive agent in accordance with DoDD 5100.03, and individuals working for or on behalf of a state, local, tribal, or private sector entity, as defined in EO 13549, who have been granted access to classified information in direct support of a DoD mission.
Background investigation An official inquiry into the activities of a person designed to develop information from a review of records, interviews of the subject, and interviews of people having knowledge of the subject.
Classified information See EO 13526 and EO13467.
Condition See “exception.”
Consolidated Adjudication Services A single activity designated by the head of the DoD Component to evaluate background investigations and other relevant information and to render final personnel security determinations. The CAS is the adju- dication authority for the Army.
Continuous evaluation A personnel security investigative process to review the background of an individual who has been deter- mined to be eligible for access to classified information or to hold a sensitive position at any time during the period of eligibility. Leverages a set of automated record checks and business rules to assist in the ongoing assessment of an individual’s continued eligibility. Supplements, but does not replace, the estab- lished personnel security program for scheduled periodic reinvestigations of individuals for continuing eli- gibility.
Contractor An expert or consultant (not appointed under 5 USCUSCUnited States Code 3109) to an agency; an industrial or commercial con- tractor, licensee, certificate holder, or grantee of any agency, including all subcontractors; a personal ser- vices contractor; or any other category of person who performs work for or on behalf of an agency (but not a Federal employee) (see EO 13467).
Controlled substance Any drug, material, or other chemical compound identified and listed in DNI Memorandum ES 2014– 00674 (see DODMDODMDepartment of the Defense Manual 5200.02).
Counterintelligence Information gathered and activities conducted to identify, deceive, exploit, disrupt, or protect against espi- onage, other intelligence activities, sabotage, or assassinations conducted for or on behalf of foreign pow- ers, organizations, or persons, or their agents, or international terrorist organizations or activities (see DODMDODMDepartment of the Defense Manual 5200.02).
Covered individuals Individuals in sensitive or national security positions (see SEAD 3 for details).
Current An investigation that is no more than 5 years old. If DISS reflects an open investigation, or a pending ad- judication not more than 1 year beyond the 5-year anniversary date, the investigation is considered cur- rent (see DoDM 5200.02).
Damage to the national security Harm to the national defense or foreign relations of the U.S. from the unauthorized disclosure of infor- mation, taking into consideration such aspects of the information as the sensitivity, value, utility, and prov- enance of that information, or other breach of security responsibilities by personnel serving in national se- curity positions (see DoDM 5200.02).

Denial The refusal to grant national security eligibility or to grant a higher level of national security eligibility to a person who possesses eligibility of a lower degree due to the presence of derogatory reportable activities.
Derogatory information Information that reflects on the integrity or character of an individual, or circumstances that suggest that their ability to safeguard national security information may be impaired, that their access to classified or sensitive information clearly may not be in the best interest of national security, or that their activity may be in conflict with the personnel security standards or adjudicative guidelines (see DoDM 5200.02).
Deviation See “exception.”
Due process An established administrative process designed to ensure the fair and impartial adjudication of facts and circumstances when an unfavorable national security eligibility determination is being considered. The process is offered to individuals before a final unfavorable determination of national security eligibility is made (see DoDM 5200.02).
Electronic adjudication (e-Adjudication) Automated adjudication (see DoDM 5200.02).
Electronic application A web-based tool for self-reporting biographic details, declarations, clarifications, and mitigating infor- mation necessary to conduct investigations. The current electronic application used within DoD (see DoDM 5200.02).
electronic-Questionnaires for Investigations Processing A secure web-based automated system that facilitates timely and accurate processing of the investigation requests. Agencies authorize applicants to access the system to enter data and documents required for the investigation; the system collects information from the applicant based on the appropriate investiga- tive questionnaire (see DoDM 5200.02).
Eligibility determination The decision to grant eligibility for access to classified information or performance of national security du- ties (see DoDM 5200.02).
Exception An adjudicative decision to grant initial or continue access eligibility despite a failure to meet adjudicative or investigative standards. For purposes of reciprocity, the presence of an exception permits the gaining organization or program to review the case before assuming security sponsorship and to accept or de- cline sponsorship base on that review. When accepting sponsorship, the gaining organization or program will ensure that the exception remains a matter of record. The authorized exceptions are condition, devia- tion, and waiver as defined in this glossary. will be required. Such measures include additional security monitoring, restrictions on access, and re- strictions on an individual’s handling of classified information. supporting background investigation. “Significant gap” means either complete lack of coverage for a pe- riod of 6 months or more within the most recent 5 years investigated or the lack of an FBI name check or an FBI fingerprint check or the lack of one or more investigative scope requirements in its entirety (for ex- ample, the total absence of local agencies checks within an investigation would constitute a deviation, but the absence of local agencies checks for some but not all places of residence would not constitute a devi- ation). that would normally preclude access. “Substantial issue information” mean information in the individual’s history that does not meet the standards of national security adjudicative guidelines. DoD component heads may approve waivers only when the benefit of access clearly outweighs any security concern raised by the shortcoming. A waiver may require special limitations on access, additional security monitor- ing, and other restrictions beyond normal need-to-know on the person’s handling of classified information.
Federal service For purposes of assessing whether or not a break in service exceeding 24 months has occurred, consists of active duty in the military services, Federal civilian employment, membership in the ARNGARNGArmy National Guard or USARUSARUnited States Army Reserve (includes troop program units, individual mobilization augmentees, and Individual Ready Reserves), membership in the Reserve Officers’ Training Corps Scholarship Program, and Federal contractor em- ployment with duties that require direct unescorted access to classified information under the NISP or a combination thereof.
Foreign contact Contact with any person or entity that is not a U.S. person.
Foreign national Any person other than a United States citizen.
Intelligence community A federation of executive branch agencies and organizations that work separately and together to con- duct intelligence activities necessary for the conduct of foreign relations and the protection of the national security of the United States.
Interim eligibility A national security eligibility determination based on the completion of minimum investigative require- ments that is granted on a temporary basis, pending the completion of the full investigative requirements.
Investigative record The official record of all data obtained on the individual from trusted ISPs, from suitability or security appli- cations and questionnaires, and any investigative activity conducted in accordance with the December 13, 2008 DNI and Office of Personnel Management (OPMOPMU.S. Office of Personnel Management) memorandum (see DoDM 5200.02).
Investigative service provider A Federal agency or federal contract agency that conducts personnel security investigations for the DoD (see DoDM 5200.02).
Limited access authorization Authorization for access to Confidential or Secret information granted to non-United States citizens and immigrant aliens, limited to only that information determined releasable by a U.S. Government designated disclosure authority to the country of which the individual is a citizen, in accordance with DoDD 5230.11. Access is necessary for the performance of the individual’s assigned duties with the military or a federal agency and is based on favorable adjudication of a 10-year scope (see DODMDODMDepartment of the Defense Manual 5200.02).
Local record check Checks local personnel, base, military police, medical, and security records, as applicable. Does not in- clude investigations off the installation or through the internet (for example, courthouse records, credit checks, and law enforcement checks).
National Industrial Security Program See DoDM 5200.02.
National security The national defense or foreign relations of the United States. Includes defense against transnational ter- rorism (see DoDM 5200.02).
National security duties Duties performed by individuals working for or on behalf of, the Federal Government that are concerned with the protection of the United States from foreign aggression or espionage, including development of defense plans or policies, intelligence or CI activities, and related activities concerned with the preserva- tion of the military strength of the United States, including duties that require eligibility for access to classi- fied information in accordance with EO 12968 (see DoDM 5200.02).
National security eligibility The status that results from a formal determination by an adjudication facility that a person meets the per- sonnel security requirements for access to classified information or to occupy a national security position or one requiring the performance of national security duties (see DoDM 5200.02).
National security information Information that has been determined, pursuant to EO 13526, to require protection against unauthorized disclosure and is so marked when in documentary form (see DoDM 5200.02).
National security position See DODIDODIDepartment of the Defense Instruction 5200.02.
Need-to-know A determination made by a possessor of classified information that a prospective recipient, in the interest of national security, has a requirement for access to, knowledge, or possession of the classified infor- mation to perform tasks or services essential to the fulfillment of an official U.S. Government program. Knowledge of, possession of, or access to classified information will not be afforded to any individual solely by virtue of the individual’s office, position, or national security eligibility (see DODMDODMDepartment of the Defense Manual 5200.02).
Personally identifiable information Information that can be used to distinguish or trace an individual’s identity, either alone or when combined with other information that is linked or linkable to a specific individual.
Personnel security A security discipline that assesses the loyalty, reliability, and trustworthiness of individuals for initial and continued eligibility for access to classified information and occupancy of sensitive positions.
Personnel Security Appeal Board A three-member panel of senior level personnel authorized to make final national security eligibility deter- minations that have been appealed by subjects of national security investigations.
Position designation The assessment of the potential for adverse impact on the integrity and efficiency of the service, and the degree to which, by the nature of the civilian position, the occupant could bring about a material adverse effect on the national security.
Reciprocity Recognition and acceptance, without further processing, in the realm of personnel security, security back- ground investigations, clearance, and access eligibility determinations. Reciprocity is obligatory in the In- telligence Community when there are no waivers, conditions, or deviations to DNI security standards.
Reinvestigation An investigation conducted to update a previously completed background investigation on a person occu- pying a public trust position, a position requiring access to classified information, or a sensitive position to determine whether that individual continues to meet the requirements for the position.
Scope The time period to be covered and the sources of information to be contacted during the prescribed course of a national security investigation (see DoDM 5200.02).
Sensitive compartmented information Classified information concerning or derived from intelligence sources, methods, or analytical process that is required to be handled within a formal access control system established by the DNI (see DoDM 5200.02).
Sensitive position Any position so designated by the head of any department or DoD component in accordance with EO 10450 (see DoDM 5200.02).
SF 86 The standard form that the DoD uses for most national security background investigations. The auto- mated version of the SF 86 is the e-App (see DoDM 5200.02).
Special Access Program Any program imposing need-to-know or access controls beyond those normally provided for access to Confidential, Secret, or Top Secret information. Such a program may include special clearance, adjudica- tion, investigative requirements, material dissemination restrictions, or special lists of persons determined to have a need to know.
Submitting office number A number that identifies the office that initiates the investigation and is recorded in the appropriate block of the investigative form (see DoDM 5200.02).
Supporting counterintelligence organization Supports CI issues involving military and civilian personnel. CI issues involving contractor personnel are referred to the FBI (see DoDM 5200.02).
Suspension of access The withdrawal of a person’s access to classified information.
Unfavorable national security determination A denial or revocation of eligibility for access to classified information and or to occupy a sensitive posi- tion (see DoDM 5200.02).
Unfavorable personnel security action Action taken as the result of personnel security action and unfavorable national security determination as defined in this regulation.
Valid passport A passport that is current (that is, has not expired and has not been cancelled or revoked) (see DoDM 5200.02).
